The South African Research Chair on Equality, Law and Social Justice recently launched its Research Report, entitled ‘Emerging from the Shadows? Equality Courts in South Africa’.

This Research Report documents the preliminary findings of research on the practical and normative roles of Equality Courts in interpreting and enforcing equality claims.
It asks who comes to the courts and what kind of redress they seek; how do the Courts interpret unfair discrimination, harassment and hate speech; and how have the courts evolved over the years? In concluding that the Equality Courts have slowly gained traction, and begun to emerge from the shadows, the Report notes the emergence of a more transformative jurisprudence in recent judgments on hate speech and unfair discrimination.
In light of these findings, the Report was launched at a webinar on ‘The Transformative Potential of Equality Courts’ [Watch here] where participants in key Equality Court cases discussed their arguments and findings.
